Agreement to tweak JTI's protective order

Last week JTI-Macdonald made public its request to the Ontario Superior Court for an amendment to the Order under the Companies' Creditors Arrangement Act that is currently protecting it from claims from injured smokers, third-party government healthcare providers and other litigants.

In its Notice of Motion it asks the court to lift the stay on litigations enough that the coimpany is able to pursue recovery of the value of a stolen truck of tobacco and also resolve a work-related injury claim. A proposed hearing on February 3rd was mentioned.

This seems to have raised no concerns, and no hearing was held. Yesterday, Justice McEwan agreed with the proposed changes, and issued an amending order.
